Which has led companies and entrepreneurs around the world to seek new forms of growth and expansion; especially those companies with a notable success, which have been able to create a method and process that allows them to implement a "KNOW HOW", and which in turn can transmit it to other investors. It is from this strengthening of the know-how and a use of the brand that originates in Europe and the United States, a type of contract called a Franchise contract, a contract that deals with this degree work, and especially the lack of autonomous legal that in our country Colombia is presented. But since the time of Emperor Justinian, who recognizes the unnamed contracts, which could be a give or a simple act. While it is true, that the franchise contract is nothing other than to organize legally, the franchise business, but because of its atypical nature, named in the context of business activity contracts. Atypical contracts are currently framed within the contracts of private international law, which essentially seek to strengthen free trade, but these contracts, such as franchise, are built with clauses that come more than the custom of merchants and They are not treated by law. This is how we note that, in Colombia, despite the increase and rise of franchises, by the different free trade agreements signed and ratified by Colombia, in our country, it has not yet been legislated on this type of contract, and any situation that must be resolved by the parties, must do so by resorting to rules established for other contracts, on which the legislator has ruled. (Concepts supported by theories set forth by (Arenilla, 2015). In Europe and the United States, the norm of the franchise agreement, not only remains in the commercial will or custom of the parties involved, in a code of ethics or in the principle of good faith, but it transcends and there is a law that regulates them more expressly. What we can show is that in Colombia it is necessary for the legislator to issue laws that regulate the franchise agreement, to protect all those small entrepreneurs and entrepreneurs, who increasingly invest their economic resources in international and national franchises. We can conclude that the franchise agreement, because it is not described in a legal type, is not specially regulated by the system. In that sense, three objectives were formulated 1) Conceptualize transitional justice and its purpose in the Colombian context; 2) Describe the Colombian armed conflict; and 3) Establish the importance of forgiveness from the legal-political dimension in the final peace agreement between the Colombian government and the FARC. Colombia has been the scene of different manifestations of violence, including those fostered by guerrilla groups that find their origin in the hegemonic political practice between the Liberal and Conservative parties that excepted through the exercise of power, from the public function to those who were not attached to any of them, coupled with social exclusion and the provision of the most favored class in the structure of the State, among other factors; which are important to undertake a process of transnational justice that includes the political forgiveness of the actors of the internal armed conflict who committed serious human rights violations.Item El papel del derecho frente a la regulación de la reproducción humana asistida y la maternidad subrogada en Colombia(Universidad Santiago de Cali, 2019) Campo, Carmen Elena; Díaz Ganados, Carmen Alicia; Giraldo Ángel, Laura AndreaEl objeto de este trabajo es analizar el papel del derecho frente a la regulación de la reproducción humana asistida y la maternidad subrogada en Colombia. En ese sentido se formularon tres objetivos específicos, a saber: 1.- Estudiar los aspectos a considerar en la regulación jurídica de la reproducción humana asistida y la maternidad subrogada; 2.- Analizar la jurisprudencia referente a la reproducción humana asistida y la maternidad subrogada; y 3.- Determinar los retos jurídicos de la legislación colombiana para regular las técnicas de reproducción humana asistida – maternidad subrogada. Se trató de una investigación básica jurídica, toda vez que se trata de describir el fenómeno, en la que se recurrió al método hermenéutica ya que se interpretó el objeto de estudio desde el derecho. La doctrina coincide en calificar de nulos a los contratos de maternidad subrogada por ser contrarios al orden público, a la moral y a las buenas costumbres; no obstante, es un fenómeno que ha escapado del control del legislador y que pese a la exhortación y órdenes de la Corte Constitucional, aún en Colombia persiste la inexistencia de una norma que la regule junto con las técnicas científicas de reproducción humana asistida. In this sense, a conceptualization of the rights to truth, justice and guarantees of non-repetition is carried out in Colombia, highlighting its fundamental principles, then addressing extrajudicial executions and transitional justice, its concepts, characteristics and main phases, then highlight the state mechanisms that guarantee the right to truth, justice and non-repetition to victims of extrajudicial executions in the framework of Colombian transitional justice and in the final part of this essay sets out some conclusions that arise as the great challenges for the country's transition from armed conflict to peace, lack of political will, corruption and lack of civil society empowerment, we must all be defenders peace process and guardians of the process as it unfolds, state disorder, the absence of the state in areas of the national territory, areas where extrajudicial executions were carried out and challenges for the guarantee of rights to truth and Colombia.Item Los principios de autonomía, independencia e imparcialidad en las decisiones jurídico penales en Colombia(Universidad Santiago de Cali, 2019) Echeverry Nieto, Andrés Felipe; Castro Ramírez, AlejandroThe present investigation studies the application of the principles of autonomy, independence, and impartiality of the actions of judicial officials in the criminal legal system in Colombia. In addition, the relevance of these principles is highlighted as a guarantee for all citizens defining the legal scope that must be contained in the decisions of the judges. For for this reason, the principles of autonomy, independence, and impartiality must protect the fundamental rights that are enshrined in our Political Constitution of 1991, and these must be guaranteed by the judges of the State, which are the highest authority in the judicial courts, without being influenced by exogenous circumstances or outside criminal procedure, as is punitive populism. In accordance with the above, the present analysis will be carried out in three stages. Initially, we will develop the concepts and the effectiveness of the principles.
