This investigative-descriptive article is structured so that the reader actively identifies as a consequence of the omissive behavior of the territorial entity before the integral and irreplaceable factor of the right of petition, the congestion that is being presented in the judicial offices in the Department of Caquetá during the 2016-2017 period in the presentation of guardianships for violation of the fundamental right of petition, which now overwhelms the constitutional judges of this department, due to the administrative oversight that is being carried out to the ordinary processes of the judicial offices and the low qualification in the performance evaluation. The reason of this scenario is the objective that arises from the same political constitution and that the fundamental right is guaranteed for all injured by means of the public function on the same territorial entity. The non-resolution of the recognition and protection of the rights resides in the head of the petitioner, he is the person who brings to the attention of the territorial authority his needs and expectations, in the hope of receiving a prompt response that solves or resolves his situation somehow. Institutional weaknesses are presented within the different levels of the administration of the UARIV and their omissive behavior before the rights of petition presented by the victims of the internal armed conflict are the product of their negligence; this causes a judgment of reproach, which justifies the harmful result that the public entity is generating. This resulted in a considerable increase in guardianships actions against the UARIV, which is causing excessive delays and high costs due to congestion in the Judicial Offices and the state responsibilities, which is justified in the figure of the service failure. Part of the non-functioning system generates damage to a person, in this case to the "victim". Considering all the above, this research carried out a deductive methodological design as a data collection technique and was carried out with a carried out by means of a circular CSJC17-021 date March 24, 2017 that were applied to the constitutional judges of the department and a statistical evaluation analysis to the congested judicial offices, this impact was assessed and generated a congestion as a result 55.21 %, as a primary information and as secondary information the definition and scope of the public function was indicated, the regulatory framework and scope of the integral and irreplaceable factor of the Statutory Law of petition. Finally, the territorial entity indicated that they manage the presidential program and the process of law of the rights of petition presented by the citizens, in order to prevent the great amount of administrative surveillance to the constitutional judges and to guarantee their fulfillment by the territorial entity and reduce court congestion in this Department

Articulación de la participación ciudadana con el control fiscal

This essay on the articulation of citizen participation with fiscal control, is a deliberation of the importance of citizen control and the union of efforts with fiscal control exercised by the general comptroller of the republic, achieving participatory fiscal control, as a strategy for the care of the public, facing corruption and seeking efficiency and effectiveness in the management of resources and public management, executed by both public sector entities and private individuals who manage state assets or resources. In this way, the articulation must be carried out within an inclusive space of respect for the independence and autonomy of both citizen control and fiscal control, guaranteeing the duties and rights enshrined in Colombia's political constitution, while at the same time improving the credibility of the citizenship in the entities that exercise fiscal control. Las asociaciones público privadas para el desarrollo de infraestructura vial en el caso colombiano, una mirada a la ley 1508 de 2012

With the entry into force of Law 1508 of 2012 that gave life to Public Private Associations in the Colombian legal system, a change was proposed in the State's management model regarding the provision of public goods and services, a new governance and a creation of horizontal networks around the active and associative participation of the private sector. The Public-Private Partnerships are the expression of this collaborative evolution of the State to achieve efficiency in the fulfillment of its objectives regarding social welfare, specifically road infrastructure, one of the items that require greater investment to improve competitiveness, and growth, which are related to a better quality of life for the entire population. In this context, the way in which the public-private partnerships were projected by the legislator is evaluated from the normative framework of Law 1508 of 2012, deepening its institutional and regulatory design for the development of road infrastructure, in order to determine its usefulness and convenience in government contracting as the axis of study of Administrative Law.
La carrera administrativa en Colombia: Evolución de los principios rectores y control constitucional

The public service of employment in Colombia has had a slow and traumatic evolution, diffuse and speculative normative concepts, analyzed from its beginnings in 1886 up to the current regime established in the Political Constitution of Colombia with the incorporation to a higher rank by the National Assembly Constituent in 1991, and subsequently in compliance with international conventions and treaties that make up our constitutional block. Contexto de la acción de tutela en Colombia

Las necesidades y problemáticas acentuadas durante la década de los 80 en Colombia, llevaron al pueblo a reclamar su soberanía y a exigir una forma de Gobierno más justa; fue así como se convocó a una Asamblea Nacional Constituyente en el año 1991 la cual trajo consigo cambios abruptos pero positivos para el país. Dada esta situación, se expidió la Constitución Política de Colombia de 1991 que rige actualmente, a partir de la cual se determinó la soberanía del pueblo, se estatuyó el Estado Social de Derecho y se crearon tanto herramientas como la Acción de Tutela como instituciones como la Corte Constitucional a fin de procurar la defensa de los derechos de la ciudadanía así como la salvaguarda de preceptos constitucionales en general. Con la reglamentación de la Acción de Tutela se otorgó al ciudadano una herramienta ágil para reclamar el amparo de sus derechos fundamentales bajo ciertos preceptos, incluso contra sentencias judiciales, siempre y cuando se cuente con el lleno de requisitos para ello.
La contratación pública en Colombia

El Estado, desde su agenda de conectividad, ha formulado acciones para hacer más ágil y transparente la contratación estatal y, de esta manera, evitar la tramitomanía en documentos y ejercicios propios de la actividad, mediante la utilización de las Tecnologías de Información y Comunicaciones (TIC). Por esta razón en consecuencia, se Implementó en la actualidad el Sistema de Información para la Contratación Estatal (SICE) y el Sistema Electrónico para la Contratación Pública (SECOP), lo cual, a pesar de los sistemas implementados, Colombia se encuentra entre los países más corruptos a la hora de contratar. Desde la Constitución de 1991 el artículo primero de nuestra carta magna donde nos habla que Colombia paso de ser un estado de Derecho a ser El Estado Social de Derecho se caracteriza por garantizar los derechos fundamentales, reconocidos a través de una Constitución, con el fin de evitar la desigualdad y que se atente contra la dignidad humana. Colombia, a través de la Asamblea Nacional Constituyente de 1991, asumiendo un compromiso con los ciudadanos se estableció como Estado Social de Derecho asumiendo de esta manera un compromiso por la defensa de los intereses de sus ciudadanos, como lo reza el artículo 1 de la Constitución Política de Colombia: “Colombia es un Estado Social de Derecho, organizado en forma de república unitaria, descentralizada, con autonomía de sus entidades territoriales, democrática, participativa y pluralista, fundada en el respeto de la dignidad humana, en el trabajo y la solidaridad de las personas que la integran y en la prevalencia del interés general” 1, desde ahí y para poder cumplir con los cometidos de la constitución se tenía que reinventar los estatutos de la contratación, entonces los aportes de la constitución fueron claves para la generación de la Ley 80 de 1993, púes se parte de los principios y postulados de la constitución con que se crean todas las leyes las cuales no pueden sobrepasar los mandatos de la constitución.

El presente artículo es una breve reseña del control fiscal que se aplica en Colombia para los servidores públicos Municipales y Departamentales, cuales son los procedimientos que se realizan para resarcir el daño causado al erario público y de la situación actual en el manejo de los recursos públicos. Igualmente se busca identificar si la función pública que realizan las Contralorías Departamentales y Municipales se está ejerciendo de manera correcta, cual es la normatividad vigente en materia de control fiscal y por ultimo realizar una propuesta a una posible solución para que las Contralorías no sean invadidas por la corrupción, lo que busca propender la disminución de la corrupción y evitar la desviación de los recursos públicos para los fines para los que se establecen dentro de la programación financiera que se realiza.
Criterios para la interpretación y aplicación del principio de ilicitud sustancial en el derecho disciplinario

In the present research project will be analyzed the criteria for the interpretation and application of the principle of substantial illegality in the disciplinary law, which is summarized in the degree of violation of the general interest of the population through the improper behavior of a citizen in the exercise of public functions. In order to comply with the general objective of the investigation, the criteria of subjective assessment, its interpretation and subsequent application will be identified, after the characterization of the criteria that make up the principle of substantial illegality. Finally, in the systematization of experience in the formulation of an evaluative element that allows the correct interpretation and proportional application of the principle of substantial illegality in the Disciplinary Law in Colombia. A qualitative methodology of exploratory type developed under the historical-hermeneutical paradigm for the processing of information will be used.

Derecho a la seguridad social en parejas del mismo sexo en Colombia

Este artículo busca examinar el tema dentro de un contexto teórico indagando sobre los antecedentes históricos de la unión marital de hecho en Colombia, su percepción social y jurídica durante la vigencia de la Constitución de 1886, para darle paso a las circunstancias que dieron pie a la creación de la ley 54 de 1990, sus antecedentes, la jurisprudencia más relevante y las razones que llevaron a su reforma con la ley 979 de 2003, todo esto en perfecta concordancia con los criterios de familia que integró el artículo 42 de la Constitución Política de 1991, y el concepto de igualdad que ésta nueva carta integró al ordenamiento jurídico. Para ello será relevante establecer la importancia que el principio de igualdad ostenta ante la unión marital de hecho en temas como la seguridad social y cómo este mismo principio de igualdad se verá reflejado en el amparo de estos derechos a las parejas del mismo sexo. También será necesario dar una mirada hacia las nuevas formas de estructuración de la familia, para así comprender, no solamente el sentido amplio que el artículo 42 de la Constitución política de Colombia otorgó al concepto de la misma reconociendo a la unión marital de hecho como una nueva forma de conformarla, sino también cómo la unión marital de hecho en parejas de mismo sexo logró equiparar el derecho a la seguridad social por su misma condición de familia. De igual manera consideramos importante dar a conocer estos nuevos tipos de familia para identificar en sentido amplio de qué manera la jurisprudencia ha estado a la vanguardia de los profundos cambios sociales para adaptar sus tesis a la realidad nacional. Así mismo, destacar la línea jurisprudencial elaborada por la Honorable Corte Constitucional, determinantes en asuntos claves como la consolidación de los derechos que otorgó la ley 54 de 1990 a las uniones maritales de hecho en Encabezado: SEGURIDAD SOCIAL PAREJAS DEL MISMO SEXO EN COLOMBIA parejas del mismo sexo, la extensión de derechos y obligaciones a este tipo de uniones en materia de afiliación al régimen de seguridad social, el derecho a recibir sustitución de pensión, derechos y obligaciones de alimentos todas ellas, así como la solemnización de la unión civil en parejas del mismo sexo, encaminadas a preservar los principios de igualdad, y libre desarrollo de la personalidad.

Corruption in state contracting has its origin in one of its manifestations such as bribery, influence management and personal benefit over and above the general benefit. The scourge of corruption is submerged in the different state functions. The areas where the denaturalization of public office is most evident are in planning, budgets, human management, the administration of physical resources and fiscal control. One of the main sources of corruption is public procurement, taking into account that a large part of the resources that are in charge of public entities for their investment, are committed to the contracting of goods and services. Regarding the main causes of corruption that occur, we can point out, among others: the imbalance of the market; absence or exaggeration of regulation norms; unjustified presence of the State and distrust of society in the way in which illicit actions are penalized, among others.
