Workplace harassment against women constitutes a form of gender-based violence that must be addressed in accordance with the human rights protection standards developed by the Inter-American Court of Human Rights. An analysis of the Supreme Court's jurisprudence from 2019 to 2023 shows that the precedent makes no direct or complete reference to the standards developed in the Inter-American system on the right to access to justice, the gender perspective, and protection against gender-based violence. This conclusion is reached by identifying the precedent of the IACHR and the Supreme Court of Justice, and then comparing and analyzing it.
