Item La revocatoria del mandato en Colombia(Universidad Santiago de Cali, 2017) Ramos Carabali, Luis Fernando; Mosquera Murillo, CeferinoThe revocation of the mandate is one of the most acclaimed participation mechanisms by citizens, and when instituted it has always been presented as a revolutionary element that intensifies the possibility of the elector to control the performance of the rulers, because it is he who has the power to remove him from office if said official is not competent, or does not meet the expectations of the community for which he was elected to serve. The Political Charter makes specific reference to the revocation of the mandate in two provisions. The first of them, article 40, indicates that the right to citizen participation is specified, among others, in the right to revoke the mandate of those elected in the cases and in the manner established by law. In turn, article 103 states it as one of the mechanisms for citizen participation. Additionally, article 259, although it does not contain a specific mention of said figure, refers to the so-called programmatic vote indicating that those who elect governors and mayors, impose by mandate to the chosen one the program that they presented when registering as a candidate. The revocation of the mandate is based on several political and legal theories, from which this figure has a preponderant role as a sign of progress in many societies. Despite this, it has been mostly unsuccessful in the world, so it is up to the citizens to resort to other mechanisms to get a president out of office who is not doing his job properly. Colombia is not strange to this phenomenon, so this paper seeks to analyze the theoretical basis and current national legislation that regulates and has shaped this citizen participation mechanism.
