This document reflects the results of research conducted on the right of victims to access to the administration of justice in the process of land restitution in the Department of Cauca, since the entry into force of the law 1448, 2011 to June 30 2016, analyzed under the theory of professor Luigi Ferrajoli guarantees. To address the issue was necessary to make a journey through the history of the Colombian armed conflict, displacement, the concept of victim and implementation of mechanisms of transitional justice in the Colombian context, ending with Law 1448 of 2011, Act victims and restitution land and its application in the department of Cauca. This thesis concludes that despite the many institutional efforts and that access to justice is an ideal primary guarantee to guarantee the right to property and economic rights of victims through the process of land restitution in practice there are many constraints that prevent the restoration of violated rights
