Item La Jurisdicción especial para la paz: un modelo de justicia transicional acorde con el derecho penal internacional(Universidad Santiago de Cali, 2019) Guerrero Peña, Diana Estefanía; Ramón Castro, Viviana AndreaThe paper analyzes the Special Jurisdiction for Peace, that is, the model of transitional justice created from the Peace Accords signed between the Government of Colombia and the guerrilla FARC-EP, with which it is intended to terminate one of the longest and most debased internal conflicts in recent history. The analysis is based on theoretical assumptions that are directly linked to the international duty of States to investigate, judge and punish serious violations of human rights. This arises from the signing of instruments of public international law that are endorsed through the legal production of regional courts. There are five models of transition that have taken place around the world, such as the International Tribunal of Nuremberg, the International Tribunal for Rwanda, Human Rights Violations in Chile, Human Rights Violations in Argentina, Criminal Court for the Former Yugoslavia, accepted by the international criminal justice system, that from its components it is possible to analyze the Colombian transitional context whose verification will always start from the contrast of the provisions of the special justice system.
