The present work aims to demonstrate the progress of the Social State of Law in favor of protecting the ethnic and cultural diversity of the territorial communities in the country, chronologically counting the legal provisions that deal with the matter, the Jurisprudence of the Honorable Constitutional Court, the Declaration of the United Nations on the rights of the peoples in general, but also that of the Indigenous Peoples and the International Agreements and Treaties that deal with the matter. In spite of the vast normative and jurisprudential accumulation, the institutionality derived from the Executive Power of the State is reluctant to guarantee the Fundamental Right to the Collective Territory of Indigenous Peoples.
