Abstract
This document responds to the interest in understanding the role of digital workers in the face of the union figure as a mechanism to promote compliance with labor legislation regarding the work modality to which these workers are subject. To this end, the theory and regulations regarding the types of contracts established in the Substantive Labor Code are reflected, delving into those established in Bill 190 of 2019, on economically dependent digital work. It also addresses relatively recent movements that seek to consolidate the union figure for the digital worker, their impact and challenges in relation to current regulations. This is due to technological advances that have brought with them new work modalities, and countries like Colombia are still in a very premature process regarding legislative formalization in favor of those who offer their services in this work modality. For this reason, the formalization of the union figure is as uncertain as the legislation itself surrounding the economically dependent worker and as recent as the digital work modality itself.

El presente documento responde al interés por conocer el rol de los trabajadores digitales ante la figura sindical como mecanismo para propender por el cumplimiento de legislativo laboral frente a la modalidad de trabajo a la que se acogen estos trabajadores, para ello, se plasma la teorÃa y normatividad en lo referente a los tipos de contratación establecidas en el Código Sustantivo del Trabajo y ahondando en la establecida en el proyecto de ley 190 de 2019, sobre trabajo digital económicamente dependiente. Asà como de movimientos relativamente recientes que buscan consolidar la figura sindical para el trabajador digital, su impacto y retos en relación a la normatividad vigente. Esto se da gracias a los avances tecnológicos que han traÃdo consigo mismo nuevas modalidades de trabajo, a lo que paÃses como Colombia aún se encuentran un proceso muy prematura en torno a la formalización legislativa en pro de quienes ofertan sus servicios en esta modalidad de trabajo, razón por la cual, la formalización de la figura sindical, está tan incierta como la misma legislación en torno al trabajador económicamente dependiente y tan reciente como la misma modalidad de trabajo digital.
