Las asociaciones público privadas para el desarrollo de infraestructura vial en el caso colombiano, una mirada a la ley 1508 de 2012

With the entry into force of Law 1508 of 2012 that gave life to Public Private Associations in the Colombian legal system, a change was proposed in the State's management model regarding the provision of public goods and services, a new governance and a creation of horizontal networks around the active and associative participation of the private sector. The Public-Private Partnerships are the expression of this collaborative evolution of the State to achieve efficiency in the fulfillment of its objectives regarding social welfare, specifically road infrastructure, one of the items that require greater investment to improve competitiveness, and growth, which are related to a better quality of life for the entire population. In this context, the way in which the public-private partnerships were projected by the legislator is evaluated from the normative framework of Law 1508 of 2012, deepening its institutional and regulatory design for the development of road infrastructure, in order to determine its usefulness and convenience in government contracting as the axis of study of Administrative Law.
