Criterios para la interpretación y aplicación del principio de ilicitud sustancial en el derecho disciplinario

In the present research project will be analyzed the criteria for the interpretation and application of the principle of substantial illegality in the disciplinary law, which is summarized in the degree of violation of the general interest of the population through the improper behavior of a citizen in the exercise of public functions. In order to comply with the general objective of the investigation, the criteria of subjective assessment, its interpretation and subsequent application will be identified, after the characterization of the criteria that make up the principle of substantial illegality. Finally, in the systematization of experience in the formulation of an evaluative element that allows the correct interpretation and proportional application of the principle of substantial illegality in the Disciplinary Law in Colombia. A qualitative methodology of exploratory type developed under the historical-hermeneutical paradigm for the processing of information will be used.
