| dc.description | El Estado colombiano, a partir de la Constitución de 1991, se declaró como un Estado Social de Derecho, en donde los valores de los Derechos Humanos se convierten en un pilar fundamental en la construcción de una sociedad incluyente y respetuosa de la diferencia étnica. En ese sentido, el presente artículo tiene como objetivo conocer el desarrollo de las acciones afirmativas para el acceso a la tierra de la población afrodescendiente en Colombia. Para dar cumplimiento al objetivo, se realizó una investigación cualitativa centrada en el análisis documental, tomando como referentes las leyes y decretos publicados a partir de la Constitución Política de 1991. Los resultados evidencian que en Colombia han existido desarrollos legales en favor del acceso a la tierra para la población afrodescendiente, los cuales muchos de ellos han sido construcciones que se han cristalizado en el marco de las realidades del conflicto interno. Sin embargo, dichos avances escritos en el papel no se han reflejado en forma eficaz para el gozo material y disfrute de la tierra de las comunidades afrodescendientes. En conclusión, aunque el marco legal colombiano ofrece importantes garantías para los derechos territoriales de estas comunidades, la brecha entre norma y realidad, sigue siendo significativa. | |
| dc.description.abstract | The Colombian State, since the 1991 Constitution, has declared itself to be a Social State of Law, where the values of Human Rights become a fundamental pillar in the construction of an inclusive society that respects ethnic differences. In this sense, the objective of this article is to know the development of affirmative actions for access to land for the Afro-descendant population in Colombia. To fulfill the objective, a qualitative research was carried out focused on documentary analysis, taking as references the laws and decrees published from the Political Constitution of 1991. The results show that in Colombia there have been legal developments in favor of access to land for the Afro-descendant population, many of which have been constructions that have crystallized within the framework of the realities of the internal conflict. However, these advances written on paper have not been effectively reflected for the material enjoyment and enjoyment of the land of the Afro-descendant communities. In conclusion, although the Colombian legal framework offers important guarantees for the territorial rights of these communities, the gap between norm and reality is still significant. | |
