Item Aplicabilidad del Principio de Legalidad con la Entrada en Vigencia de la Ley 1952 de 2019, bajo el Principio de Favorabilidad(Universidad Santiago de Cali, 2023-09-19) Cuellar Castro, Fabian Dario; Vargas Renza, Yudy Paola; Cano Sterling, Andres Felipe (Director)Law 1952 of 2019 General Disciplinary Code, was reformed by Law 2094 of 2021, and entered into force on march 30, 2022. therefore, it must be made clear that Law 734 Unique Disciplinary Code is still in force and its procedural structure for processes in which the List of Charges has not yet been duly notified or the disciplinary sunbject has not been summoned to a hearing in the verbal process. Therefore, it is essential to analyze the situation that has ocurred with the principle of legaity, since it estabishes that the disciplinary subject, will be disciplined for behaviors that are described as misconduct in the law in force at the time of its realization, strictly regulated for the two (02) Codes. In this sense, that is where principle of favorability should be studied.
