Item Análisis del decreto 216 de 2021: ¿trato diferenciado o discriminación?(Universidad Santiago de Cali, 2023-02-14) Upegui Mayor, Valentina; Leon Gomez, Diego (Director)Migration is a social fact that is increasing day by day, therefore, it constantly require new application challenges to the laws of the countries that are the origin, destination and transit of the regular or irregular migrant population. Currently, countless people leave their native places to settle in a different territory, with what this represents in social, legal and economic terms. In the development of the international legal framework on migration, the rights of equality and non-discrimination make it possible to know the application of national norms on the foreign population in the territory; Therefore, this article analyzes Decree 216 of 2021 under the light of two criteria: “differential treatment” and merely discriminatory acts towards migrants; to determine if it is falling into discrimination due to the time limit imposed by the aforementioned norm.
