Both this new virus and the disease it causes were unknown before the outbreak in Wuhan, China, in December 2019.” The first case in Colombia was confirmed on March 6, 2020, which led to the declaration of the State of Economic, Social and Ecological Emergency throughout the national territory, for this reason Decree 417 of 2020 is issued by the President of the Republic, for a term of thirty calendar days, counted from its validity, in accordance with the powers granted by article 215 of the Political Constitution, which was subsequently extended by Decree 637 of May 6, 2020 and so on , for the time to date. But in contractual matters in the face of this contingency, different dynamics have been exhibited around the performance of contracts, so this research focuses on analyzing decree 440 of 2020 modified by decree 537 of 04/12/2020 on state contracting.
