Item Determinantes Legales y Sociales para la priorización del Macrocaso 02 de la JEP Situacion Territorial de Ricaurte, Tumaco y Barbacoas (Nariño)(Universidad Santiago de Cali, 2023-09-26) Ocampo Bernal, Carlos Antonio; Giraldo Ángel, Laura Angela (Director)Transitional justice establishes an equitable, democratic, and dignified system that recognizes violations of Human Rights and serious violations of IHL, providing victims in contexts of armed conflict with legal tools for access to justice, reparation for the damage caused, truth clarification and non-repetition measures. With the consecration of Legislative Act 01 of 2017, Law 1922 of 2018 and Law 1957 of 2019, procedural mechanisms have been adopted to make effective the work of transitional justice in prioritized territories. In this sense, the present investigation establishes as a general objective to analyze the legal and social determinants for the prioritization of Macro Case 2 of the JEP, regarding the territorial situation of the municipalities of Ricaurte, Tumaco and Barbacoas located in the Nariño area that include subjective criteria. such as victim transgression, impact on collective subjects, identification of those responsible, importance of the facts, dimension of victimization and representation of the facts. The findings within the study have recognized advances in Macro Case 2 such as accreditation of victims, creation of Afro-Colombian and Indigenous community councils, with special participation of the Awá and Eperára Siapidará Indigenous community, as well as the community Afro-Colombian people. With full participation in the appearances to grant truth, reparation and justice to the victims, demonstrating fairness and inclusion on the part of the JEP, giving victims and perpetrators a leading role with relevance for a comprehensive intervention and implementation of actions with ethnic-racial, territorial approaches and gender to indigenous communities, Afro-descendants, peasants, women and the LGTB population, through intercultural dialogues, with testimonies for the achievement of transformative justice.
