Item Análisis a la responsabilidad extracontractual del estado por falla del servicio(Universidad Santiago de Cali, 2018) Pai Pantoja, Libia Marcela; Moreno, FerneyThe basic principle of the law anyone who causes damage to another, has the obligation to repair it, translates into responsibility. The administrative responsibility stipulated in Article 90 of the Political Constitution covers both contractual and extracontractual liability of the State. There, the three determining requirements are also indicated: the unlawful damage, the action or omission of the agent, and the causal link between them. However, such responsibility can be exonerated through the causes that jurisprudence and doctrine have been commissioned to substantiate; in them is the fact of a third party. The essential thing in this case, as stated by the Council of State, is that this third party, external to the state activity, breaks the causal link between the action or omission of the State and the damage, in such a way that its intervention is decisive in the result. However, in view of the duty to protect the State, it is necessary to clarify the situation when it is sought to attribute responsibility to the State for terrorist acts.Item Análisis de la responsabilidad médica contractual del médico en la cirugía plástica(Universidad Santiago de Cali, 2018) Cordoba Tello, Yenny Patricia; Moreno, FerneyMedical responsibility has been one of the topics most experienced by legal theorists. However, few theories have been built from the national reality and the Colombian health system, an omission that has led to a large number of errors. Any thesis on this subject must take into account how health in Colombia works, since it is about identifying who should respond for the damages caused in the provision of the service. But in this essay we focus on Plastic, Aesthetic, Reconstructive or Reconstructive Surgery, as the surgical specialty representative of restoring the anatomical or functional integrity of the human body, altered by physical, congenital or acquired defects.Item Análisis jurídico del derecho fundamental a la educación y la responsabilidad estatal por la falla en la prestación del servicio(Universidad Santiago de Cali, 2020) Serna Rios, Ceidy Jhoana; Cordoba Murillo, Ivon; Moreno, FerneyThe model of education pursued in most Western societies is guided by the principles of democracy. The aim of education is the formation of free or autonomous citizens. The implementation of a democratic educational model in Colombia has been, and continues to be, obstructed by a number of factors (external and internal). Lack of access to institutions, deficiencies in infrastructure, lack of teachers properly trained to deal with special cases, difficulties in guaranteeing the physical integrity of students and teachers, discrimination (racial or gender), diversion of resources and censorship are just some of the limitations imposed by the Colombian reality on the consolidation of the right to education as a performance, fundamental and right-duty right. The failure to provide the service, in terms of education, occurs when the State cannot comply with its obligations in the presence of negligent conduct by officials. The methodological scope of the research that gave rise to this article is descriptive and the tool used to gather information was a literature review.Item Una breve conceptualización del derecho administrativo Colombiano: La modernización aplicada a los principios del Estado Colombiano desde su máximo órgano de control(Universidad Santiago de Cali, 2018) Barreto Urueña, Andrés Mauricio; Moreno, FerneyThe modernization of Administrative Law and its adaptation to the new Colombian legal regime, stemming from the 1991 Political Charter, has not been a truly flexible issue. Because this process has generated great resistance and has caused a lot of doubts due to the new applications that are given to the standards. In this way it can be said that at present it is not possible to know, in tenacity, in what order Colombian Administrative Law continues to be coupled with classical legocentrism and the habitual idea of an internal and closed legal environment, alien to society, which predominated until the promulgation of the current Constitution, or if, on the contrary, it is formally directed towards the primacy of fundamental guarantees and the Bill of Rights. This article presents a brief outline of the Colombian state, where the fundamentalist modernization suffered by the Colombian legal system and the process of constitutionalization of Administrative Law will be analyzed. From this observation arise two trends grosso modo, the first a current that initiates or directs this branch of law towards its modernization and the second renewal of the ideological slopes in the State Council that seeks a sympathy to traditional conceptions or reluctance to its full harmonization with the new legal system. However, the New Code of Administrative Procedure and Contentious Administrative Law (Law 1437 of 2011), can compose an energetic promotion of legal order to the process of renewal of this branch of law due to legal postulates that harmonize the protection of guarantees of citizens regarding public administration.Item El contrato de prestación de servicios, frente al contrato laboral, sus diferencias y similitudes. Well, it is not easy to understand that in an Ordinance so full of norms that can stop such behaviors, of a reprehensible nature, they are presented day by day. Identifying the legal and legal elements that characterize the crime of influence peddling and establishing the relationship between influence peddling and public bidding. Analyzing the Colombian contracting statute Law 80 of 1993, focused on corruption, influence peddling in contractual processes such as public bidding and through an analysis of the modifications that the statute has had with Law 190 of 1995 and Law 1150 of 2007, as well as its regulatory decrees. This responsibility is not only of the public entities and authorities but also of the State's servants since they must act under strict subjection to the constitutional principles that guide the exercise of the public function and also tend for the preservation of the principle of morality in the scope of the legal duties of the public administration as well as be careful of public property and when appropriate, act in defense of it. The means of control of Repetition has been enshrined as a guarantor of the rights of the State itself, and its purpose is aimed at recovering the sums of money that the State has had to pay for acting maliciously or seriously guilty of one of its servers or former public servants.Item Eficacia de la ley 181 de 1995 en el reconocimiento de la pensión para los deportistas colombianos(Universidad Santiago de Cali, 2017) Bonilla Quijano, Luis Alfredo; Moreno, FerneyEste proyecto de investigación surge de la necesidad de analizar la aplicación del principio de eficiencia, de la Ley 181 de 1995 en el reconocimiento de la pensión para los deportistas colombianos. La investigación está encaminada a establecer si realmente la legislación deportiva, es eficiente en el cubrimiento de la pensión para todos aquellos que se dedican diariamente a la práctica del deporte. En el desarrollo de los antecedentes del tema y al observar la situación existente en materia de seguridad social para los deportistas, se plantea el problema de forma adecuada. Se enuncia una pregunta muy concreta, sobre la existencia de una normatividad que garantice un cubrimiento efectivo en cuanto a pensión se refiere para los deportistas colombianos, llevándose a cabo la formulación del problema. Dentro del desarrollo del tema de investigación y como primer aspecto, se toca lo concerniente a la seguridad social y el deportista aficionado en Colombia. Posteriormente se llegan a establecer las diferencias existentes en materia de seguridad social en pensión, entre el deportista aficionado, de alto rendimiento y el profesional en Colombia. Luego se habla del deporte como profesión en Colombia y las diferencias marcadas entre el deportista de alto rendimiento y el aficionado.
