Item La autonomía local en la declaratoria de territorios libres de transgénicos como garantía al derecho de la soberanía alimentaria(Universidad Santiago de Cali, 2020) Muñoz Alvear, María Cristina; Macana, Marco AntonioThe right to food sovereignty has become a conflict between peasant and indigenous communities with the State and their agro-industrial policies, since these communities argue that through this model it is impossible to guarantee this right, due to the techniques of production that are used based on the excessive use of agrochemicals and genetically modified seeds. There is a scenario in which food is commercialized through public policies that support foreign investment and away from the rights of the rural population, by focusing on single-species plantations, rapid production under industrial techniques required by multinationals foreign for export, therefore, move away from the small producer and encourage the concentration of land. In this research, under a descriptive and explanatory analysis, the autonomy of local communities is analyzed, which manifests itself as a participatory and democratic exercise that the rural population uses to guarantee their right to food sovereignty, along with other legal manifestations that make these viable. statements; and starting from the theory of law as Ferrajoli's system of guarantees, other secondary sources are interpreted under the complement of a field analysis based on personal communication with one of the main leaders who has participated in the declarations of GMO-free territories in Narino. In this sense, it is concluded that the communities defend their right to food sovereignty, limiting the power, the wild power of foreign multinationals and the power of the State that supports these investments, based on a political and participatory exercise, with which Communities are turning their backs on the use of transgenic seeds and on the agro-toxic and agro-industrial obligations that derive from them. The declarations of transgenic free territories are a democratic right that limits these powers; the idea that everything has a price and has an owner must be demolished, because from this the rights of the producing communities cannot be guaranteed, nor the rights of the hungry community, on the contrary, this further opens the gap to inequality and the people are not going to allow this. Here there is a broad normative support in favor of diversity, healthy food, natural food and people's participation, and this is what guarantees food sovereignty.Item Conflictos de jurisdicción en procesos de reconocimiento de sanción moratoria por el no pago oportuno de las cesantias de los servidores públicos(Universidad Santiago de Cali, 2017) Montealegre Duran, Stephania; Cifuentes Melo, Jennifer; Macana, Marco AntonioEl presente ensayo tiene con fin establecer una posición jurídica y sustentable frente a quién es el operador jurídico competente en sede judicial para conocer y tramitar los asuntos en que se está requiriendo el reconocimiento y pago de la sanción moratoria derivada del no pago oportuno de las cesantías a las que tiene derecho un servidor público, conforme lo establecen el artículo 5 de la Ley 1071 de 2006. Tras ser analizados los principios constitucionales, normatividad vigente, realidad fáctica y precedentes jurisprudenciales, este artículo realiza una propuesta consistente en que teniendo en cuenta que el acto administrativo que niega el reconocimiento de la sanción moratoria, contiene en sí mismo una decisión de la administración que niega un derecho al empleado público, no puede la Jurisdicción Administrativa negarse a ejercer control de legalidad respecto del mismo, todo en aras de salvaguardar los derechos que le asisten al ciudadano y la libre decisión del solicitante. En ese sentido, la Jurisdicción Competente para decidir sobre el reconocimiento del derecho a la sanción moratoria, en nuestro criterio sería la Jurisdicción Administrativa, es decir, los jueces administrativos o Magistrados del Tribunal Administrativo según sea el caso.Item Criterios que se deben tener en cuenta para la adecuación del tipo penal del feminicidio desde la legislación y la jurisprudencia, 2015 y 2016(Universidad Santiago de Cali, 2017) Horta Losada, Ana María; Macana, Marco AntonioThe criminal type of femicide, as an autonomous crime, was necessary to fill the legal void left with Law 1258 of 2008, in order to determine with greater precision the elements concurrent or that have preceded the death of the woman as circumstance that allows to infer to the existence of the mobile - to kill to a woman by the fact of being woman or for reasons of gender identity -, making flexible the approach of the test in the feminicidio and allowing that in the context it is possible to be evidenced the intention of the Author; and the obligation of the State to act diligently in the protection and prevention of all forms of discrimination against women on the grounds of gender identity and which have been imposed in the Convention of Belém do Pará, the United Nations Declaration on the Elimination of Violence against Women and General Recommendation No. 19 of the Committee to Monitor the Convention on the Elimination of All Forms of Discrimination against Women - CEDAW. A través del desarrollo de la OTCA y la revisión de las agendas de política exterior se aborda las amenazas y retos que enfrenta la región para la consolidación de un escenario de cooperación . Los autores analizan la complejidad de la región que se debate entre problemas locales, como el tráfico de especies naturales y el narcotráfico, frente a retos globales como son las demandas de los mercados mundiales a través del aprovechamiento sustentable de los recursos naturales estratégicos. In this respect, the present text starts with a introductory reflection that glimpses the relations given between armed conflict and drug trafficking in the recent history of Colombia. Then it goes to review thoroughly the content and the normative scope of article 23 of the so-called Amnesty Act, with the purpose of clarifying and supporting the possibility that within the framework of the processes that are advanced in the JEP, it can be considered to drug trafficking as a related political crime in the resolution of specific cases that would not have erga omnes effects. However, it is made clear that in no case may crimes related to drug trafficking be elevated to the category of a political crime for the purpose of granting de Jure AmnestyItem Responsabilidad del Estado en la regulación de los disruptores endocrinos como garantía del derecho a la seguridad alimentaria(Universidad Santiago de Cali, 2020) Echeverry Gallego, Nohora Cecilia; Macana, Marco Antonio; Zapata Galvis, JulianaIt has been shown that many of the chemicals called Endocrine Disruptors used in agri-food activity have the ability to break into the endocrine system of humans and animals causing serious consequences; the present work reflects on the responsibility of the Colombian State, imposed by the Constitution and the International Covenants on Human Rights, and Economic, Social and Cultural, to establish rules limiting their use in food activity as a guarantee of the right to food security and related rights. From bibliographic data collection, hermeneutics was used as a method for the interpretation of normative texts and other secondary sources. It was found that there is no regulation on endocrine disruptors and that it is considered in Colombia and some South American countries as an unjustified barrier to trade while the European Community has regulated them. Likewise, we want to show how these systematic changes in the construction of public criminal policy are not disconnected from other processes of transformation of social practices and institutions in general, which will be reflected, among others, in public opinion , recognizing the need to formulate a more comprehensive interpretation that recognizes the complexity of these processes, and that is why the main objective of this work is to describe and interpretes the criminal policy implemented by the Colombian State against the criminal responsibility of adolescents. Since the nineties, with the adoption of the Convention on the Rights of the Child, a systematic process of reform of the legislation and policies of the States in relation to the rights and obligations against children and adolescents has been initiated. One of the most controversial points of this process has been the criminal responsibility of adolescents, which is shown as one of the most representative and controversial cases in the attempt to build a universal system to face the multiple difficulties that children and girls face. the teenagers of the world.
