Item Impacto del litigio estratégico como mecanismo para el acceso de las mujeres a una justicia efectiva en Colombia(Universidad Santiago de Cali, 2024) Guerrero Cando, Danna Nicolle; López López, Diego EstebanThis essay has the purpose of addressing the impact that access to justice in Colombia would have with the application of strategic litigation as an alternative for visibility and effectiveness regarding women's rights, starting from a global perspective; taking a journey through history and determining both nationally and internationally the areas in which these have participated and where they have managed to obtain that recognition for the incessant search for recognition and prevalence of their rights as women and human beings to live a dignified life, free of violence and without political, labor, economic or social discrimination. In the same way, it is intended to establish what challenges or barriers strategic litigation could face, whether in the face of possible opposition from institutions -both national and international- or various factors such as lack of resources. to access the maximum well-being that assists them as people, likewise, the existing routes of action that promote the protection and safety of women against any type of violence will be identified. Finally, an attempt will be made to establish the scope that strategic litigation would have as a tool that contributes to guaranteeing access to justice and the elimination of impunity in relation to one of the crimes typified in the Colombian Penal Code -Law 599 of 2000-. , such as Es Femicide (art 104A), based on the treatment given internationally to related crimes that particularly affect women, within the framework of the protection of human rights, taking into account the punitive aggravations.
