Item Una Aproximación A La Conciliación Como Mecanismo Restaurador Dentro Del Proceso Penal(Universidad Santiago de Cali, 2024) Gallego Vives,Geraldine; Escobar Ospina , Carlos Andrés (Asesor)Conciliation in criminal law is a unique mechanism, considering that it addresses the right to liberty and, in turn, the right to life of a person. Conciliation is an alternative for restoring rights, which is vital, since the current criminal justice system fails to achieve the resocialization of convicted persons or effective reparation for victims, who are often left without compensation for their harm. Therefore, this essay seeks to delve deeper into the importance of conciliation as a mechanism for restoring harm. To this end, it will address which issues are and are not conciliable within the criminal process, and analyze the benefits that a paradigm shift in the Colombian judicial system would entail.
