Establishing civil liability in aeronautical law is a significant challenge due to the inherent complexity of airspace and the unclear regulation in this field. Aviation has generated a series of conflicts, including the need to determine the criteria and regulations relevant to airspace usage, which involves the exercise of each State's sovereignty. Additionally, there arises the need to establish criteria and forms of liability for damages incurred during aerial activity. This entails analyzing the events that cause the damage, the nature of the damage, the causal link between the wrongful act and the resulting damage, and the degree of accountability associated with liability. In response to these challenges, various international instruments have been signed with the aim of regulating all aspects related to aerial activity and promoting uniformity in principles and rules. The convergence of national and international interests in this field underscores the importance of establishing clear and effective regulations to address the legal challenges inherent in aviation and ensure safe and sustainable development of this industry
