Item La criogenización humana: discusiones socio jurídicas sobre la personalidad y la identidad(Universidad Santiago de Cali, 2023-09-07) Dorado Delgado, Diana Milena; Lozano Cuervo, Juan Carlos (Director); Solano, Jhon Alexander (Director)Human cryogenization supposes a possibility of returning to life after death, conserving the deceased body for an indeterminate time at extremely low temperatures, while a cure is found for the pathology that caused the death. But what are the social and legal implications of cryogenics in the 21st century, regarding the identity personality in the return to life of a person preserved in time? Faced with the problem, the objectives were to review the regulations on the subject, to categorize the socio-legal implications on the identity personality in the return to life of a dead person preserved by cryogenization and to establish criteria tending to guarantee the identity personality of the people who come back to life and their family nucleus, taking into account that with death the legal personality is considered extinguished and it is not defined from the Law whether the resurrection would be a new birth or an extension of the same personality. The research had a qualitative approach, descriptive type, the information screening prism was applied, selecting 17 readings related to the research problem. The main results allowed us to define that there is no legal support to support this type of practice, so it is necessary to formulate control instruments that allow regulating all the conditions of manner, place and time for its development. The preservation of the identity personality arises under the application of the legal figures deceased memory, testamentary executor and living will. The main recommendation is to give an early solution to the possible dilemmas raised from Biolaw with everything that technological advances imply, since they are a reality worldwide and quickly reach different countries such as Colombia.
