Item Elementos condicionales para la implementación de la maternidad subrogada en Colombia(Universidad Santiago de Cali, 2017) Chamorro Manchabajoy, Brayan Alexander; Cortez Martínez, Elda Ruth; Jaramillo Rojas, Carlos AlbertoIn this essay, the current state of surrogacy in Colombia is presented, based on the jurisprudence that has been issued by the constitutional court and the different texts that refer to the topic. We will present from our point of view about the relevant aspects of the T-968 sentence of December 2009 regarding surrogacy, and how this sentence accepts methods of assisted reproduction as a mechanism that helps people that can’t naturally procreate, also to bring to the attention the bills that are presented at the congress on the subject of debate, since although it is true that by the sentence T-968 of December of the year 2009 this kind of practice is allowed there are legal gaps that need to be clarified to avoid a bad exercise of these methods, on the other hand the different arguments that are against maternity surrogate are questioned and how each of these may be objectionable.
