The concept has evolved, as has happened with society, because of this, the denomination of Habeas Corpus has been universalized, which has the double condition of being a fundamental right and at the same time a public action, its transcendence it has allowed it to be related in the domestic jurisdiction in harmony or consonance with the international treaties signed by Colombia. Its importance requires that its procedure be preferential and summary before any judge of the republic. In this article we will try to establish the correspondence between the international legislation, the national legislation and the effectiveness of the figure in regard to its origin in ongoing processes, under the accusatory criminal system
