Trazando Un Camino Hacia La Dignidad: Análisis De La Eutanasia Para Pacientes Con Intenso Dolor En Colombia A La Luz De La Sentencia C-233/2021, Caso De Martha Sepúlveda.
(Universidad Santiago de Cali, 2024) Arizala Gonzalez, Maria Alexandra; Ospina Molina, Pablo Sergio (Tutor)
This research project seeks to contribute to the comprehensive understanding of the application of euthanasia in Colombia, considering both legal and ethical aspects, providing significant insights for the future development of policies and practices related to the right to die with dignity. The inclusion of the perspective of “Émile Durkheim” will enrich the sociological analysis, offering a more complete understanding of how social norms and collective values influence individual decisions regarding euthanasia. The research will use a mixed approach, combining legal analysis, review of specific cases and qualitative methods. Relevant aspects of the Judgment “C-233/2021” and emblematic cases will be taken into account, focusing on the experience of Martha Sepúlveda. The literature review and documentary analysis will contribute to contextualizing the theoretical and legal framework. In Colombia, euthanasia has been a topic of debate and legislative evolution since decriminalization in 1997. Sentence “C-233/2021” marks a milestone in this context, outlining specific parameters for the application of euthanasia. However, the effectiveness and practical implications of this ruling, especially in cases of severe pain, still require detailed evaluation. This study focuses on understanding how the sentence affects the autonomy of patients and the exercise of their right to die with dignity.
